In 2019 SB 326 was passed which requires HOA’s and condominiums to inspect their balconies at least every 9 years. The findings of the inspection must be incorporated into the reserve study. In some cases if the inspector finds damage repairs will need to be made. Since this is still a brand new law there are still some unknowns. We do recommend adding a line item to condo reserve studies for balcony inspection and repair every 9 years. It applies to any exterior elevated element (EEE) that is 6 feet above the ground so stairways and walkways are also included. The inspection must be performed and stamped by a licensed architect or engineer. The first inspection must occur before January 1st, 2025.
